USER AGREEMENT
Welcome to the website ("Site") for ApplyWise LLC ("ApplyWise"). This User Agreement, including our Privacy Policy, governs your use of the Site and the ApplyWise products.
Please read this User Agreement carefully, because by visiting or using the ApplyWise Site or the ApplyWise products, you agree to follow the ApplyWise rules and terms of use. From time to time we may modify these rules and terms of use. We will provide notice of any significant change by posting a notice on our home page. Your continued use of the Site and the ApplyWise products after any modification indicates your agreement to the new rules and terms of use.

Please review our Privacy Policy, which is a part of this User Agreement and describes how ApplyWise handles any personally identifying information collected from visitors to the Site.

This Site and all materials included therein are owned by or licensed to ApplyWise and all rights are reserved. You must abide by all copyright notices and restrictions contained on this Site. You may not copy, distribute, enter into a database, display, perform, create derivative works of, transmit, or otherwise use any materials from this Site (including computer programs or other code) ("Site Materials"), unless we have specifically authorized you to do so in writing, and then only for personal, non-commercial use, and only if you do not alter the text or remove any trademark, copyright, or other notice displayed on the Site Materials.
TRADEMARKS
APPLYWISE, is a trademark owned by ApplyWise LLC. (the Trademark"). You may not use the Trademark in connection with any product or service that does not belong to us, or in any manner that is likely to cause confusion among users about whether we are the source, sponsor, or endorser of the product or service, or in any manner that disparages or discredits us.
LINKS, FRAMES, AND METATAGS
You may link to the home page of the Site as long as the link does not cast us in a false or misleading light, provided, that we reserve the ability at our sole discretion to revoke your right to link to the home page of the Site. You may not frame the content of the Site. You may not use metatags or any other "hidden text" that incorporates the Trademark or our name without our express written consent.
LINKS TO OTHER WEBSITES
This Site may contain links to other websites, including sites for companies associated with ApplyWise. This User Agreement and the Privacy Policy do not apply to these other websites. Be sure to read the user agreements and privacy policies that govern your use of these other websites.

You represent that you will complete all requested information in the ApplyWise products truthfully to the best of your knowledge.
DISCLAIMER AND LIMITATION OF LIABILITY
THIS SITE AND THE INFORMATION, CONTENTS, GRAPHICS, DOCUMENTS AND OTHER ELEMENTS INCLUDED HEREIN (COLLECTIVELY THE "CONTENTS") ARE PROVIDED ON AN "AS IS" BASIS WITH ALL FAULTS AND WITHOUT ANY WARRANTY OF ANY KIND. ApplyWise does not and cannot write Your essays.
APPLYWISE DOES NOT GUARANTEE ADMISSION INTO ANY SCHOOL, COLLEGE, UNIVERSITY OR SIMILAR PROGRAM. THE ADMISSIONS PROCESS IS OFTEN ARBITRARY AND ACCORDINGLY IT IS EXPRESSLY AGREED THAT APPLYWISE IS IN NO WAY LIABLE FOR ANY DECISION MADE BY AN ADMISSIONS COMMITTEE.
GOVERNING LAW
This User Agreement will be governed by the laws of the State of New York applicable to contracts made and performed there without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts sitting in the State of New York and New York County and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
TERMINATION
We reserve the right to suspend the Site or your use of the Site or terminate this User Agreement at any time without notice for any reason, including, in the case of the User Agreement, for your violation of any of its provisions. The Disclaimer and Limitation of Liability and Governing Law sections of this User Agreement shall survive any such termination.
WEBSITE PRIVACY POLICY
ApplyWise LLC (ApplyWise) takes your privacy seriously. We know you trust us to help with your college admissions process and we want you to know that you can trust us with your personal information.
WHY WE NEED YOUR PERSONAL INFORMATION
ApplyWise personalizes your online admissions counseling experience. Accordingly, we need to collect some personal information from you to set up your account with us. Here are some of the things we need your personal information to be able to do:
- Make your counseling sessions more personalized
- Store all of your past sessions and data in the dashboard so you can review them anytime
- Complete your purchases
- Contact you about your account
- Send you newsletters by mail or email about our service
- Ask you for your feedback to help make our service better
- Respond to your email requests for information and/or customer service You trust us with your personal information and we do everything we can to make sure your information is safe in our systems. Some things we will NOT do are:
- We WILL NOT sell your personal information to anyone
- We WILL NOT send you promotional mail if you tell us not to You Control Your Personal Information
If your parents/guardians and/or your school pay for or subsidize the cost of your admissions counseling, we may share your personal information with them at their request. This includes the content created by you throughout the ApplyWise sessions. If you choose not to share certain confidential information that you create within the ApplyWise course with your parents or guardians, we will not share your Personal Information with them. We May Share Your Personal Information For Safety Reasons
If we have reason to believe that disclosing your Personal Identification is required by law, or is otherwise reasonable to protect someone from possible injury, we may do so. Transfer to the United States If you are located outside of the United States, please note that the personal data you provide to us will be transferred to the United States. Whenever you submit any personal data to us, you consent to this transfer.
COOKIES
Cookies are files that your Web browser puts on your computer when you visit a Web site. We use cookies to tell us how often you visit our site, and what pages you go to on our site. The cookie itself does not have personal information in it, so no one except ApplyWise can figure out who you are from our cookie. Sometimes we use files from other companies (called third-party cookies) to help us see where people go on our website, to improve our services. Third-party cookies do not contain any personally identifying information, and the third party can not figure out who you are, or contact you.

SECURITY
ApplyWise is concerned with the security of your personal data. To keep that data secure, we restrict unauthorized access through protective policies, procedures, and technical measures. In addition, ApplyWise uses standard security protocols and mechanisms to transmit sensitive data such as credit card details.

TERMS AND CONDITIONS TO ACCEPT BEFORE CONFIRMING PURCHASE OF APPLYWISE COURSE
We at ApplyWise believe that you have a right to perform at your best, and we are totally committed to helping you get into the colleges of your choice. If you are not satisfied with the ApplyWise program within thirty(30) days of enrolling, contact ApplyWise via email (support@applywise.com) or phone (866-55ADMIT). We require a detailed explanation of why you are not satisfied. Write Cancel in the subject of the email and include your detailed explanation and your full name and phone number. You will receive a confirmation email. If you do not receive a confirmation email, please re-contact ApplyWise. Only the credit card holder may request a cancellation. Your payment will be fully refunded plus you will receive an additional 10% of the purchase price. Your login will be deactivated and you will lose the work that you saved in the program. Please allow up to 6 weeks for refunds to be processed. By accepting the terms of the User Agreement, I understand and acknowledge the following:
- ApplyWise content is for the exclusive use by ApplyWise students solely for the purpose of preparing for the college admissions process.
- All techniques and course materials, including software and electronic content remain the property of ApplyWise LLC. No information, written or verbal, or any copies of these materials may be distributed to any third parties without the prior written consent of ApplyWise.
- I have completed the browser check above and understand that the minimum modem requirement is 56K and that MAC users must use Netscape 4.7 running in Classic OS mode to use ApplyWise online.
- I will have access to my ApplyWise Junior Year Program until June of my senior year.
